Question:

84 Ms O'Donnell asked the Minister for Justice if a further enquiry, apart from the inquest, is required into the death of a person (details supplied) who was being transferred to a mental hospital by the gardaí; and if she will make a statement on the matter.

A detailed coroner's inquest, which, in effect, is a sworn public inquiry, was conducted in April 1993 into the tragic death of the person in question. The deceased person's family was represented at the inquest by a solicitor who cross-examined the gardaí involved and other witnesses in the case. In addition, the Garda authorities conducted a full investigation into the incident and forwarded the file to the Office of the Director of Public Prosecutions, who directed that further proceedings were not warranted. I do not consider that a further inquiry in this case is required.
