239 Mr. D. Ahern asked the Minister for Transport, Energy and Communications the number of successful prosecutions in each of the years from 1990 to 1995 in respect of illegal passenger carriage; and if he will make a statement on the matter. [4873/96]

In 1995 a successful prosecution was brought by the Minister for Transport, Energy and Communications against a person who was engaged in the occupation of a road passenger transport operator without being the holder of a Road Passenger Transport Operator's Licence contrary to the requirements of Regulation 4 (1) of the European Communities (Road Passenger Transport) Regulations, 1991 (S.I. No. 59 of 1991).

I should explain that, in general, enforcement of legislation relating to road passenger transport is a matter for the Garda Síochána and I am not in a position to supply information in that regard.
