Question:

165 Mr. Creed asked the Minister for Agriculture, Food and Forestry if he will have arrangements made in future forestry policy for an arbitration procedure with regard to classification of lands being planted where a dispute arises regarding enclosed or unenclosed status. [12276/96]

The definition of enclosed and unenclosed land under the CAP afforestation scheme is clearly set out in the Department's booklet entitled Afforestation Grant Scheme and Forest Premium Scheme and in the Department's technical guidelines for forestry contracting companies. I do not believe that there is a need for an arbitration procedure as any such disputes can normally be resolved on the ground.
