Question:

618 Mr. Briscoe asked the Minister for Justice whether it is an offence for motorists to speak on hand-held mobile telephones whilst driving; and if she will make a statement on the matter. [15635/96]

I am informed by the Garda authorities that there is no specific provision under the Road Traffic Acts prohibiting the use of hand-held mobile telephones by drivers of moving vehicles. However, if driving is accompanied by some action or inaction on the part of the driver which itself suggests a contravention of the Road Traffic Acts, a prosecution may be appropriate.
