327 Mr. Higgins (Dublin West) asked the Minister for the Environment and Local Government if he will supply a list of local authorities which have valid hazardous waste plans; and the date of their implementation. [19080/97]

I propose to take Questions Nos. 326 and 327 together.

The adoption and implementation of a waste plan or a special waste plan by a local authority are matters for the local authority concerned under the European Communities (Waste) Regulations 1979 and the European Communities (Toxic and Dangerous Waste) Regualtions 1982. I understand that all relevant local authorities have adopted such plans. Information in relation to the dates of adoption is set out in the following table. I have no function with regard to determining the validity of such plans.

Section 6 of the Waste Management Act, 1996 provides for the revocation of the above mentioned regulations. Waste plans and special waste plans made under the regulations will in due course be superseded by waste management plans and a national hazardous waste management plan to be made under Part II of the Act.

328 Mr. Higgins (Dublin West) asked the Minister for the Environment and Local Government the regulations, if any, he will make under the Waste Management Act, 1996 during 1998; and the approximate date of issue of each regulation. [19081/97]

Proposals are being developed in my Department for further regulations under the Waste Management Act, 1996 in relation to the following matters: a permit system for the control of commercial waste collection; controls on movements of hazardous waste; control of waste recovery activities; the recovery of batteries and accumulators; the incineration of hazardous waste; the disposal of PCBs and PCTs; packaging and miscellaneous other matters.

The regulations will be made on a progressive basis over 1998 as detailed proposals are finalised.
