Question:

138 Mrs. B. Moynihan-Cronin asked the Minister for Agriculture and Food when payment of a 22 month beef premium, a ten month beef premium and a slaughter premium will be made to a person (details supplied) in County Kerry; and if he will make a statement on the matter. [12901/98]

The person concerned declared a forage area of 96.92 hectares on his 1997 area aid application. All maps available to the area aid unit have been digitised and validated against aerial photography and the area calculated is 69.44 hectares. This represents an overclaim in excess of 20 per cent. As a result, my Department has no option under EU regulations but to impose a 100 per cent penalty on all area aid based livestock payments. A letter has issued to the person concerned stating this and affording a final opportunity to submit maps which were not submitted previously for land declared in 1997.
