Question:

66 Mr. Noonan asked the Minister for Justice, Equality and Law Reform if an amendment is being considered to the Road Traffic Act, 1994, in view of the recent judgment at Dublin District Court dismissing four drink driving cases on the basis that the integrity of the specimens could not be guaranteed from the time they were given to the Garda and their arrival at the bureau; and if he will make a statement on the matter. I am informed by the Garda authorities that the medical bureau of road safety has confirmed to them that where specimens of blood-urine are analysed and a certificate is issued by the bureau under the Road Traffic Act, 1961, as amended they are satisfied with the integrity of the specimen. I understand the Garda authorities are in consultation with the Chief State Solicitor in regard to the cases referred to by the Deputy.
