Question:

139 Mr. C. Lenihan asked the Minister for Defence if the Army deafness case will be examined for a person (details supplied) in Dublin 24 regarding the failure of his Department to pay on a claim validly secured in court. [12946/99]

I have had this matter fully examined. The position is that the Department has been awaiting legal advice in this case concerning the lodgement of an appeal. This advice has now been received and is being examined. A communication will issue to the solicitors acting on behalf of the person in question in the near future.

It is suggested that the person should contact his solicitor shortly for further information.
