120 Mr. Wall asked the Tánaiste and Minister for Enterprise, Trade and Employment the reason carers are not included in the Organisation of Working Time Act, 1997; and if she will make a statement on the matter. [19965/99]

The Organisation of Working Time Act 1997 provides for statutory rights for employees in respect of rest, maximum working time and holidays. It applies to the generality of employees. In the Act an employee is defined as "a person of any age, who has entered into or works under. a contract of employment". Accordingly, carers who are employees within the meaning of that term are covered by the provisions of the Act and are, therefore, entitled to the rights and protections provided for therein.
