Question:

169 Mr. Timmins asked the Minister for Finance the position with respect to the Real Tennis Court Building, Earlsfort Terrace, Dublin 2, which is currently under the control of the Office of Public Works; and if he will make a statement on the matter. [3663/00]

The property at Earlsfort Terrace, Dublin 2, to which the Deputy refers, is owned by the State and is occupied by University College Dublin as an engineering laboratory. In June 1999, An Bord Pleanála upheld the decision by Dublin Corporation to grant planning permission to the Office of Public Works to provide a recital hall for the National Concert Hall at this location.

Subsequently, a notice of motion was lodged with the High Court seeking a judicial review of An Bord Pleanála's decision.

The matter is being dealt with by the Chief State Solicitor's office, which has advised that the case has not yet been heard by the High Court. Pending a resolution of this issue, the Office of Public Works is not undertaking any works on the site. Until the legal process has been concluded it would be inappropriate to comment further.
