Question:

316 Mr. Ring asked the Minister for Social, Community and Family Affairs if he will give a detailed breakdown of the way an overpayment calculation was reached for the estate of a deceased person (details supplied) from County Mayo; and the amount his Department is agreeable to accept in settlement of this debt. [10443/00]

Following the death of the person concerned the schedule of assets indicated that he had capital which he had not disclosed to the Department in connection with his claim for old age non-contributory pension. His means were therefore revised, giving rise to an apparent overpayment of some £9,000. On further examination, however, it emerged that he was entitled to a pro rata pension based on his British and Irish insurance records. This reduced the overpayment to £5,378.50. The case has been considered under the Department's code of practice for the recovery of overpayments and a settlement of £4,000 has been agreed.
