346 Mr. Wall asked the Minister for Justice, Equality and Law Reform when a decision will be made regarding a Land Registry decision for a person (details supplied) in County Kildare in view of the fact that the delay is causing major problems for the person concerned (previous Parliamentary Question No. 273 of Tuesday, 22 February); and if he will make a statement on the matter. I refer the Deputy to my previous answer to Question No. 273 of Tuesday, 22 February 2000.

I am informed by the Registrar of Titles that this application under section 49 of the Registration of Title Act, 1964, was lodged on 5 November 1999. I am sure the Deputy will appreciate that applications under section 49, i.e. acquisition of title by virtue of long possession, require detailed examination of the applicants claim for registration as owner and, as such, take some time to process.

I am further informed that, as part of the process of such examination, the Land Registry must serve notice on any parties who may have any interest in the property. I understand that an objection has been received in respect of one such notice served. The Land Registry issued a letter on 17 May 2000 to the objecting party informing them of the procedures for lodging an objection and stating that, if no objections are received on affidavit within 18 days of 17 May 2000, the application for registration will proceed.

I can assure the Deputy that the Land Registry will do everything possible to expedite the resolution of this application.
