192 Mr. Perry asked the Minister for Agriculture, Food and Rural Development if he will intervene on behalf of a person (details supplied) and waive all penalties applied in view of the fact that due to medical problems at the time of completing the form, he made a genuine error, and duplicated the tag numbers of two animals; if he will make a favourable decision; and if he will make a statement on the matter. The person named made an application for eight beef cows under the 2000 suckler cow premium scheme and for eight beef cows and 15 other animals under the 2000 cattle headage scheme. When the application was being processed for payment it was discovered that two of the beef cows applied on were entered on the claim twice and were subsequently deleted without penalty. The applicant was notified of the decision in writing on 26 June 2000.

The person in question was paid a 60% advance of £530.60 on six suckler cows on 16 October 2000. He was paid his full entitlement of £877.13 under the 2000 cattle headage scheme on 25 October 2000. This is an accordance with clause 27 of the terms and conditions governing the scheme which sets limits on the amount of grant to be paid per forage hectare. The forage area as shown on the 2000 area aid application of the person named was 15.35 hectares. Based on this area, the grant payable was £877.13. If no restriction applied, the grant would have been £951.40. Accordingly, the grant of the person named was restricted by the difference between the two amounts, which was £74.27.

Any appeal submitted by the applicant with supporting medical evidence will be given careful consideration.
