Question:

124 Mr. Ring asked the Minister for Social, Community and Family Affairs when an appeal for a person (details supplied) in County Mayo will be finalised. [2836/01]

Following a review of the person's entitlement, payment of pre-retirement allowance was discontinued as his means, derived from his holding and his spouse's earnings, were above the limit entitling him to payment.

His appeal against this decision was considered by an appeals officer who has asked that some aspects of the means assessment be further examined. The papers have been referred to a local officer for this purpose.
On receipt of the further information the appeal will be considered by the appeals officer.
Under social welfare legislation decisions in relation to claims must be made by deciding officers and appeals officers. These officers are statutorily appointed and I have no role in regard to making such decisions.
