108 Mr. Callely asked the Minister for the Environment and Local Government the procedures involved regarding the planning process in respect of an application for reclamation of foreshore by Dublin Port Company; and if he will make a statement on the matter. [3383/01]

At present, development on the foreshore, which is outside the functional area of the planning authority, is not subject to normal planning controls. However, Part XV of the Planning and Development Act, 2000, provides that permission shall be required in respect of development on the foreshore in circumstances where, if the development is carried out, it would adjoin the functional area of the planning authority or any reclaimed land adjoining the functional area of the planning authority. This will apply to all types of development, including reclamation of land, if it is not otherwise exempt in accordance with the Act or regulations made under the Act. The normal processes relating to applications for planning permission under Part III of the Act will apply. A person proposing to develop on the foreshore will continue to be obliged to seek a foreshore licence in accordance with the Foreshore Acts, 1933 to 1998.

Regulations are currently being prepared by my Department which will enable me to bring the development control provisions of the Act, including the provisions in Part XV concerning development on the foreshore, into force. Some of these regulations require the prior approval of both Houses of the Oireachtas and I propose to submit draft regulations for approval before the end of March.
