Question:

114 Mr. Bradford asked the Minister for Agriculture, Food and Rural Development if correspondence (details supplied) has been received and considered by his Department; and if the additional area aid payment can be made. [10550/01]

The person named submitted a 2000 area aid application on which he declared a total of 20.90 hectares made up of several parcels. This application has been fully processed and payments issued based on this figure.

Correspondence was received on behalf of the person named on 14 December 2000 in relation to the addition of a further land parcel. However, under EU regulations amendments to a 2000 area aid application could not be accepted after 31 May 2000.

Question:

115 Mr. Durkan asked the Minister for Agriculture, Food and Rural Development if he will further review the various applications for cow and heifer premiums which were previously refused in the case of a person (details supplied) in County Kildare; if similar applications in similar circumstances have been approved; and if he will make a statement on the matter. [10598/01]

The position as set out in my reply to Parliamentary Question No. 139 on 7 December 2000 remains unchanged. The case has been reviewed on numerous occasions and the decision regarding non-payment of grants under the 1991 and 1992 suckler cow premium schemes cannot be changed having regard to the EU regulations governing the schemes. Where an applicant is deemed to have made a false declaration, as is the situation in this case, the penalty applied is exclusion from the scheme for the year in question and for the following scheme year.
