377 Mr. Kenneally asked the Minister for the Environment and Local Government the person responsible for taking action under the Derelict Sites Act, 1990, when the derelict site is in the ownership of a local authority; and if he will make a statement on the matter. [23771/01]

Under the Derelict Sites Act, 1990, it is the primary duty of a local authority to take all reasonable steps to ensure that any land situated in its functional area does not become or continue to be a derelict site. This includes land owned or occupied by a local authority. Reserve power is also vested in the Minister for the Environment and Local Government to direct a local authority to take such steps as may be specified by him or her so as to prevent any land owned or occupied by them from becoming or continuing to be a derelict site.
