Question:

428 Mrs. Owen asked the Minister for Justice, Equality and Law Reform the EU directives relevant to his Department which are awaiting implementation; the nature of the directives; when each was passed by the Council of Mini sters; the date for implementation; if the Government sought a derogation; if so, the date of such derogation; if he will meet the deadline as required; and if he will make a statement on the matter. To facilitate the practice of the profession of lawyer on a permanent basis in a member state other than that in which qualification was obtained.

14 March 2000No derogation sought.Regulations to implement the provisions of the directive will be made following enactment of the Solicitors (Amendment) Bill, 1998 which is before the House.

EU Council Directive 95/46/EC

The protection of individuals with regard to the processing of personal data and on the free movement of such data.

24 October 1998No derogation sought.Transposition of the directive was delayed due to its complexity and to other legislative priorities. Drafting of the Data Protection (Amendment) Bill is well advanced and it will be published when other legislative priorities permit. It is envisaged that significant parts of the directive will be implemented by way of regulations which are at the final stages of preparation.

EU Council Directive 2000/43/EC

Implements the principle of equal treatment of all persons irrespective of racial or ethnic origin

To be transposed by 19 July 2003.No derogation sought.It is intended that the directive will be transposed by the due date.

EU Council Directive 2000/78/EC

The purpose of the directive is to lay down a general framework for combating discrimination on the grounds of religion or belief, disability, age or sexual orientation as regards employment and occupation

2 December 2003No derogation sought.In order to take account of particular conditions, member states may, if necessary, have an additional period of three years from 2 December 2003, for a total of six years, to implement the provisions of the directive on age and disability discrimination.It is intended that the directive will be implemented within the given deadlines.

The adoption of a draft council directive amending EU Council Directive 91/308/EEC

To prevent the use of the financial system for the purpose of money laundering

Agreed at an ECOFIN council last year

Mid-2002No derogation sought.Implementation of these changes will be effected by statutory instrument under the Criminal Justice Act, 1994.It is intended that the deadline will be met.
