81 Mr. Deasy asked the Minister for Agriculture, Food and Rural Development if, where a dairy farmer involved in intensive milk production has an outbreak of BSE in his herd, he will ensure that the farmer concerned is compensated for the loss in income brought about by his inability to market his milk; and if he will make a statement on the matter. [30283/01]

BSE legislation provides that farmers are compensated at current market value rates for animals that have been depopulated as a result of BSE. The compensation is paid to enable farmers to restock. Repopulation of the farm is normally permitted 30 days after satisfactory completion of cleansing disinfection so the farmer need not be out of business for a prolonged period of time. There is no provision for payment of other compensation in respect of BSE depopulations.
