138 Mr. Killeen asked the Minister for Health and Children his plans to ensure that the provisions of article 113 of the local government (superannuation consolidation) scheme, 1998, are interpreted in an equitable manner as they apply to retired nurses; and if he will make a statement on the matter. I propose to take Questions Nos. 138 and 146 together.

I understand that the local government (superannuation consolidation) scheme referred to by the Deputy makes provision for waiving the abatement of pension in certain specified circumstances. In applying this provision my Department must take cognisance of the advice of the Department of Finance, which has overall responsibility for the conduct of public sector superannuation schemes, in relation to possible implications for the local government superannuation scheme in particular and public sector superannuation schemes in general. My Department is, however, continuing to keep the appropriate application of the relevant waiver provision under review, including in relation to any anomalies arising, in the context of the implementation process for the final report of the Commission on Public Service Pensions. This is being undertaken in consultation with the Department of Finance and the Department of the Environment and Local Government, which currently administers the superannuation scheme for health board employees.
