Question:

202 Mr. Ring asked the Minister for Agriculture, Food and Rural Development the reason a person (details supplied) in County Mayo has not been paid his REP scheme money. [10157/02]

The application for payment in this case was received on 22 January 2002, and is being processed in accordance with the targets set out in the protocol on direct payments to farmers.

Question:

203 Mr. Boylan asked the Minister for Agriculture, Food and Rural Development the payments under all schemes which are outstanding in respect of a herd (details supplied); when final payments will be made; and if he will make a statement on the matter. [10180/02]

The person named applied for premium for 20 animals under the 2001 suckler cow premium scheme. He has been paid his full entitlement under this scheme as follows: the 80% advance amounting to €3,298.40 issued to him on 28 November 2001, and the balance of €824.60 issued to him on 31 January 2002. The person named applied for special beef premium on 10 April 2001, in respect of one animal. This application has been processed and an 80% advance has been paid. The balancing payment will issue in April.

Eligibility for 2001 slaughter premium has been established in respect of three animals. However, payment in respect of these animals has not issued as my Department has not received a producer acknowledgement form from the person named. A new form has issued this week and payment will be made when it is signed and returned to the beef premium unit in Portlaoise.

204 Mr. Boylan asked the Minister for Agriculture, Food and Rural Development the payments under all schemes outstanding in respect of a herd (details supplied); when final payments will be made; and if he will make a statement on the matter. [10181/02]

The person named applied on 12 cows and one heifer under the 2001 suckler cow premium scheme on 24 May 2001. Two of the animals applied on were removed from the herd during the six months retention period of the scheme without the required ten day notification to my Department of either the removal or replacement animal details. My Department wrote to the person named on 30 November 2001, advising him that these animals were being rejected and that payment on his remaining eligible animals would be subject to a reduction penalty in accordance with the terms and conditions governing the scheme. Following a request by the person named my Department reviewed this decision and he was advised by letter of 4 February 2002, that there was no change to the original decision. He was given the opportunity to appeal this decision to the independent headage and premia appeals unit. To date, no appeal has been received from the person named.

Advance payment under the 2001 slaughter premium scheme has issued to the person named in respect of 12 animals. Balancing payments will commence in May 2002 when the quota position has been established. The person named made six applications in respect of special beef premium 2001. Applications dated 15 January 2001, 14 May 2001, 21 August 2001, and 23 October 2001, have been processed and 80% advance payments have issued. The applications submitted on 17 December 2001, and 24 December 2001, are processed and the 80% advance payment will issue this week. The balancing 20% payments will issue in April in respect of all applications.

205 Mr. Boylan asked the Minister for Agriculture, Food and Rural Development the payments under all schemes outstanding in respect of a herd (details supplied); when final payments will be made; and if he will make a statement on the matter. [10182/02]

A herdowner must submit a valid area aid application for the relevant year in order to be considered for payment beyond a limit of 15 livestock units. No area aid application was received from the herdowner for the year 2001. The person named qualified for slaughter premium 2001 in respect of ten animals and also for national envelope top-up payments on two heifers. Advance payments have issued. Balancing payment will issue in May when the final national quota position has been established.

206 Mr. Boylan asked the Minister for Agriculture, Food and Rural Development the payments outstanding under all schemes in respect of a herd (details supplied); when final payments will be made; and if he will make a statement on the matter. [10183/02]

A parcel claimed by the herdowner is part of a commonage on which a cumulative overclaim has arisen. The area aid unit is currently examining the documentation received in the context of seeking to clarify the correct entitlement to area aid on this commonage. It is hoped to have this exercise completed shortly. No payment can issue until this problem has been resolved. A solicitor acting for the herdowner has also contacted this Department. The herdowner applied for premium for seven animals under the 2001 suckler cow premium scheme. The application has been processed to payment stage and payment will issue as soon as the area aid details are finalised. The person named submitted no applications under the 2001 special beef scheme and had no animals eligible for 2001 slaughter premium.

The 2001 area aid application for the herd owner has been fully processed with an area determined for payment purposes of 19.47 hectares. The herd owner applied for premium for six animals under the 2001 suckler cow premium scheme. Payment of his suckler cow premium entitlement will issue within the next seven days. The person named applied for special beef premium on 18 June 2001, in respect of two animals. This application has been processed and 80% advance has been paid. The balancing payment of 20% will issue in April. Advance payment under the 2001 slaughter premium scheme has issued to the person named in respect of two animals. Balancing payments will commence in May 2002 when the national quota position has been established.

(Mr. Walsh): The person named applied on 23 animals under the 2001 suckler cow premium scheme on 29 June 2001. Four of these animals were removed from the herd during the six months retention period of the scheme without the required ten day notification to my Department of either the sale or of replacement animal details. My Department wrote to the person named on 30 November 2001, advising him that these animals were being rejected and that payment on his remaining eligible animals would be subject to a reduction penalty in accordance with the terms and conditions governing the scheme. Following a request by the person named my Department reviewed this decision and he was advised by letter of 13 February 2002, that there was no change to the original decision. The person named subsequently provided further information concerning these animals and the case in currently being re-examined. My Department will write to the person named as soon as this re-examination is completed. The person named made one application in respect of five animals for special beef premium 2001. This application has been processed and one animal was sold within retention. The resultant penalty of 20% was applied on the remaining eligible four animals and an 80% advance payment has issued. The balancing 20% payment is scheduled to issue in April.
