346 Mr. Wall asked the Minister for Justice, Equality and Law Reform if he will investigate the application by a person (details supplied) in County Kildare regarding a transfer; and if he will make a statement on the matter. [14465/02]

The person referred to is serving an 18 month prison sentence, which was imposed at the Special Criminal Court on 5 February 2002, for membership of an unlawful organisation and was initially committed to Portlaoise Prison. He subsequently disassociated from the subversive grouping with which he had been associated and was transferred from Portlaoise Prison to Wheatfield Prison on 7 June 2002. While the person referred to in the question has been seeking a transfer from Wheatfield Prison to either Portlaoise or the midlands prisons, it has not been possible to accede to this request for operational and security reasons.
