Question:

474 Mr. Naughten asked the Minister for the Environment and Local Government the secondary legislation outstanding within his Department; the function of each piece of secondary legislation; and if he will make a statement on the matter. [5527/03]

I presume the question refers to secondary legislation required to be made either by mandatory provisions of national legislation or to transpose existing EU legislative requirements. As far as can be reasonably ascertained, the following are at present the outstanding items within my Department's remit in relation to these headings:

Secondary Legislation

Function

Large Combustion Plant Regulations

To transpose Directive 2001/80/EC of the European Parliament and of the Council of 23 October 2001 on the limitation of emissions of certain pollutants into the air from large combustion plants.

Genetically Modified Organisms (Deliberate Release) Regulations

To transpose EU Directive 2001/18/EC on the Deliberate Release of GMOs to the Environment.

European Communities (Building Societies: Accounts) Regulations

To assimilate the law relating to the annual accounts of building societies with those of banks. The regulations will set down a specific format-layout that must be adhered to in presentation of the various accounts.

European Communities (Conservation of Wild Birds) Regulations

To facilitate the hunting of the wood pigeon during its reproductive cycle (giving effect to certain provisions of the EU Birds Directive).

European Communities (Zoos Directive) Regulations

To transpose the EU Zoos Directive in relation to the regulation of Zoos.

Secondary Legislation

Function

Statutory Instruments to designate Special Protection Areas

Ongoing programme to designate Special Protection Areas under the Birds Directive.

Regulations under section 96B of the Planning and Development Act 2000 (inserted by the Planning and Development (Amendment) Act 2002)

To prescribe the form of receipt of payment received under that section.

End-of-Life Vehicles Regulations

To give full effect to the EU Directive on End-of-Life Vehicles (2000/53/EC).
