Question:

128 Ms O. Mitchell asked the Minister for Health and Children if the facility referred to in Parliamentary Question No. 347 of 9 December 2003, although called a hospital for historic reasons, is in fact a long stay facility and as such is exempt from the smoking ban. [31731/03]

The position in regard to the current regulations is as set out in my reply to Parliamentary Question No. 347 of 9 December 2003. In regard to the proposed regulations, long stay facilities will not be covered by the ban as they are equivalent to places of residence. However, it remains the responsibility of the owner, manager or other person in charge of the facility to ensure that health and safety workplace requirements are met.
