Select Committee on Enterprise and Economic Strategy debate -
Wednesday, 3 May 1995

SECTION 7.

Question proposed: "That section 7 stand part of the Bill."

This section is very broad. Not alone does it ensure that corporate bodies discharge their responsibilities but also that their directors and staff do so. What is the position if directors of corporate entities fail to discharge their duties but are no longer directors when this is discovered?

If they were directors at the time an offence was committed, the section would apply to them, even if they were no longer directors. It depends on their status at the time the offence was committed. The liability would be attached to that status.

Question put and agreed to.
Sections 8 and 9 agreed to.
Title agreed to.
Report of Select Committee.

I propose the following draft report:

The Select Committee has considered the Bill and has made amendments thereto. The Bill, as amended, is reported to the Dáil.

Is that agreed? Report agreed to.

Ordered to report to the Dáil accordingly.

I thank all the spokespersons and Deputies who contributed to the debate. I also thank the Minister, her staff and the staff of the House.

On behalf of the Minister, Deputy Lowry, I thank the Chairman, the Members of the Committee and the staff for their consideration.

I thank the Minister and everybody involved. We would appreciate an indication of the date for Report Stage. I am not a member of this committee and there were difficulties yesterday regarding amendments, consultation and securing agreement on certain matters. If there were advance notice of when it is proposed to take Report Stage we would be ready to co-operate.

You should communicate with the Minister about that.

With respect, the Deputy should communicate with his party Whip. The Whips will decide the timing of Report Stage and, like the Deputy, I will simply be informed. I do not have an input to that decision.

When we put down amendments we do not do it in consultation with the party Whips.

I outlined what has always been the normal procedure.

The timing is one thing — the deadlines for amendments are another matter.

Deputy Treacy should ask his party's convenor, Deputy Nolan, to sort the matter out. We will endeavour to co-operate with you.

The Select Committee adjourned at 4 p.m.
