The Joint Committee on Justice, at its meeting on October 21, considered the draft of the Personal Insolvency (Amendment) (No. 1) Bill, on foot of a request by the Minister for Justice to the Business Committee for a waiver from Pre-Legislative Scrutiny.
A key provision of the proposed legislation is to remove the blockage to debtors, particularly mortgage holders who may have fallen into arrears arising from the COVID-19 Pandemic.
The Committee chaired by Deputy James Lawless agreed that, to avoid any delay in the publication of this legislation, it would recommend that the Business Committee would agree to waive Pre-Legislative Scrutiny on the Bill.
Following the meeting, Deputy Lawless said: “Members welcomed the stipulation by the Business Committee that this Committee be given the opportunity to review this draft of the Bill before any decision on the Minister’s request for a waiver was made. We are happy to make this recommendation to the Business Committee and look forward to engaging with the Minister with the view to the Bill’s speedy passage.”
