Mr. Ryan

asked the Minister for Local Government whether his Department or the Dublin Corporation gave approval for the erection of an advertising balloon in O'Connell Street, Dublin; and if he will state the powers which local authorities or his Department have to prevent the disfigurement of buildings and of city and town centres by like advertising material.

Approval was not given by me or by Dublin Corporation. I understand that the corporation are advised by their Law Agent that an advertising balloon would constitute a sky sign within the meaning of Section 91 of the Public Health Acts (Amendment) Act, 1907, and that as the balloon was erected without a licence under that section, they have requested that it be removed. Local authorities have power to serve notice requiring the taking down and removal of any unauthorised sky sign and in default may carry out the work themselves and recover their expenses. In addition a person acting in contravention of Section 91 is liable to a penalty not exceeding £5 and to a daily penalty not exceeding twenty shillings.
