asked the Minister for the Public Service in view of the refusal by a State Board (details supplied) to implement a Labour Court recommendation, whether a State board financed entirely by public funds can refuse to implement a Labour Court award.

The statutory position in regard to Labour Court recommendations is set out in section 68 of the Industrial Relations Act, 1946, as amended by the Industrial Relations Act, 1969. Such recommendations may be accepted or rejected by employer or employee. No differentiation is made between public sector and private sector.

In regard to specific cases in State bodies, these are primarily the responsibility of the boards of the bodies concerned.
