asked the Minister for Justice if his attention has been drawn to the fact that a person (details supplied) in Dublin 8 who was married over three years ago to an Irish citizen at the Dublin mosque has been refused Irish citizenship, though meeting the three year marriage requirement, because his marriage at the Dublin mosque is not recognised; if his attention has further been drawn to the fact that the person concerned who is a citizen of Malaysia has a child born in Ireland and his wife is expecting their second child shortly to be born in Ireland; and if, in all the circumstances and notwithstanding the legal technicality on which he is being refused citizenship, he will grant citizenship in the case concerned.

I understand that the person referred to in the question is not entitled to postnuptial citizenship as a matter of law.

Citizenship by naturalisation is a separate matter and, as I indicated to the Deputy in late 1988 there were then grounds on which an application by the person concerned had to be deferred.

I am now prepared to reconsider the application on the basis of present circumstances.
