Written Answers. - Release of Prisoners.

Question:

75 Mrs. T. Ahearn asked the Minister for Justice if he is prepared to grant a two-day release to a prisoner (details supplied) in Cork prison, prior to his final release; and if he will make a statement on the matter.

Each application for temporary release is considered on its individual merits. Regard is had to the circumstances giving rise to the application and factors such as the nature of the offence, length of sentence served, behaviour while in custody, the previous record of the offender and the possible risk which a release may pose to the community.

It is open to offenders at any time to make a request through the governor for periods of temporary release but no such request has been received in this case. Any request received will be considered by reference to the aforementioned criteria.

Question:

76 Mr. Gregory asked the Minister for Justice if, in view of the tragic and untimely death of the father of a young prisoner (details supplied), he will consider his early temporary release on compasionate grounds as he is his mother's only support.

The prisoner referred to by the Deputy in his question was granted three days' temporary release to attend his father's funeral. Subsequently I authorised a further period of temporary release, on compassionate grounds, to enable the offender to reside with his mother.

Each application for temporary release on compassionate grounds is considered on its individual merits. Regard is had to the circumstances giving rise to the application and factors such as the nature of the offence, length of sentence served, behaviour while in custody, the previous record of the offender and the possible risk which a release may pose to the community.

I have very carefully considered all of the circumstances of this case but I am not prepared, at this stage, to grant any further periods of temporary release. The case will, of course, continue to be kept under review.
