Written Answers. - County Clare Court Case.

Question:

107 Mr. Bell asked the Minister for Justice if his attention has been drawn to (a) the circumstances leading to the conviction of a person (details supplied) in County Clare under section 3 of the Road Traffic (Amendment) Act, 1984, (b) the fact that this case was adjourned on nine occasions over the 14 month period from 13 June 1991 when first called at the District Court, Ennis, County Clare and (c) the fact that when the final case was called this person was advised that a further adjournment would be sought and because he was working he did not attend and the case was disposed of in his absence; if in view of the extraordinary circumstances involved, he will waive the penalty imposed; and if he will make a statement on the matter.

I understand from the Garda authorities that the case was subject to adjournment between June 1991 and January 1992. When the case was finally heard in January 1992 a plea of guilty was entered on behalf of the person concerned and the case was disposed of. An appeal was subsequently heard and the conviction was upheld. As Minister for Justice, I have no powers to waive a conviction.
