23 Mr. Gormley asked the Minister for Arts, Heritage, Gaeltacht and the Islands if her attention has been drawn to the damage being done to the Boyne estuary by the Drogheda port development; and her views on whether it is necessary to seek court injunctions to ensure a port company complies with environmental commitments. 139 Mr. Sargent asked the Minister for Arts, Heritage, Gaeltacht and the Islands the views of her Department on the destruction caused by the ongoing development in the Boyne Estuary; and the further action, if any, she is instructing her Department to undertake. [20690/99]

I propose to take Questions Nos. 23 and 139 together.

I presume that the Deputy is referring to the fact that the spoil from dredging works in the estuary is being spread over the polder at Stagrennan. My Department is satisfied that no significant or permanent damage is being caused by these works.

While, as a general rule I would prefer if it were not necessary to seek court injunctions to ensure that a developer complies with environ mental commitments, it is possible that such action may be necessary from time to time in certain cases.
