248 Mr. Naughten asked the Minister for Justice, Equality and Law Reform when a decision will be made in relation to the new maternity leave entitlement; and if he will make a statement on the matter. [3850/01]

The order to give effect to the increased maternity leave entitlements was made on 8 February 2001 following the passing of resolutions by the Dáil on 6 February and the Seanad on 8 February. An order to increase adoptive leave entitlements was also made on that date.

In summary, the orders provide as follows: any woman who commences maternity leave on or after 8 March will be entitled to 18 weeks paid leave and eight weeks unpaid leave; any woman who commences additional unpaid maternity leave on or after 8 March following on her 14 weeks paid leave will be entitled to eight weeks unpaid leave; any adopting mother or sole male adopter who commences adoptive leave on or after 8 March will be entitled to 14 weeks paid leave and eight weeks unpaid leave; any adopting mother or sole male adopter who commences additional unpaid adoptive leave on or after 8 March will be entitled to eight weeks unpaid leave; entitlement of fathers to maternity and adoptive leave in the event of the death of the mother will also be increased in respect of fathers commencing leave on or after 8 February. In the case of a father who is already on maternity leave, the increased entitlement to additional unpaid maternity leave will apply with effect from 8 March.
