Vol. 37 No. 17

Ceisteanna—Questions. Oral Answers. - Alleged Assault by Peace Commissioner.

asked the Minister for Justice if he is aware that Jeremiah Hurley, P.C., of Killeena, Carrigtwo-hill, was fined five pounds by the District Justice for assault at the Cork District Court; and if he intends to continue Jeremiah Hurley as Peace Commissioner for this district.

I have had inquiries made into this case and having regard to all the circumstances I do not consider it desirable in the public interest to remove Mr. Hurley from the office of Peace Commissioner.

Does the Minister consider that a gentleman who has been fined £5 by the District Justice for a brutal assault is a suitable person to administer law in the district?

I do not accept the term "brutal assault."

Is the Minister further aware that in fining this gentleman £5 for assault the District Justice commented that he was the greatest perjurer that had ever appeared before him and does the Minister intend taking any steps to have this gentleman prosecuted for perjury?

I am not aware of any such statement by the District Justice.

Will the Minister have inquiries made?

Thank you.
