Ceisteanna—Questions. Oral Answers. - Road Transport Licence.

asked the Minister for Industry and Commerce if he is aware that the Great Southern Railway Company, on the 11th November last, acting in pursuance of an Order made by him under the Road Transport Act, 1933, took over the Road Transport Licence No. 950 held by Raymond Finnegan, Abbeyleix; that in April, 1936, the railway company were furnished with two years' audited accounts; that to date they have made no offer of compensation to the licence holder; that the business was the sole support of the licence holder and his family; that owing to the delay in paying compensation hardship is ensuing, and if he will take steps to ensure that the railway company fulfil their obligations under the Act, or hand back the licence to the licence holder.

The Road Transport Act, 1933, provides that the compensation payable on the compulsory transfer of a merchandise licence shall, in default of agreement between the parties, be determined by an arbitrator to be appointed, at the request of the Minister for Industry and Commerce, by the Reference Committee provided for in the Act. No application for the appointment of an arbitrator has been made to me nor have I had any evidence of disagreement as to the amount of compensation payable in the case referred to in the question, in the absence of which I am unable to take any action in the matter.
