Private Business. - Local Government (Galway) Bill, 1934.

I move:

(1) Go mbeidh sé de chead ag bunathóirí an Bhille Rialtais Aitiúla (Gaillimh), 1934, do bhí ar feitheamh sa tSeanad ar dháta an Achta Bhunreachta (Leasú Uimh. 24), 1936 (Uimh. 18 de 1936), do rith ina dhlí dul ar aghaidh sa Dáil le Bille bheidh ar aon dul i ngach slí leis an mBille do bhí ar feitheamh amhlaidh, gan scrúdú do dhéanamh maidir le cólíonadh na mBuan-Orduithe i dtaobh Gnótha Phríobháidigh;

(2) go ndéanfaidh na bunathóirí fógra i dtaobh iad a bheith ar intinn dul ar aghaidh leis an mBille do thabhairt uatha tré chóip den Bhille d'fhágáil in Oifig na mBillí Príobháideacha agus deimhniú fé láimh Ghníomhaire Pháirliminte na mbunathóirí ceangailte dhi á rá go bhfuil an Bille ar aon dul i ngach slí leis an mBille do bhí ar feitheamh amhlaidh sa tSeanad;

(3) go ndéanfar, an chéad lá shuidhfidh an Dáil tar éis an fhógra intinne sin do bheith tugtha, an Bille do chur síos chun Orduithe do dhéanamh ag cur an Bhille fé bhráid Rogha-Choiste do réir Bhuan-Orduithe 66 (Gnó Príobháideach), mar tuigfear an Bille do bheith tugtha isteach agus a dhara céim do bheith rithte aige;

(4) ná héileofar aon táillí alos aon chéime den Bhille nuair a híocadh táillí cheana alos na céime céanna i gcás an Bhille bhí ar feitheamh amhlaidh sa tSeanad.

(1) That the promoters of the Local Government (Galway) Bill, 1934, which was pending in the Seanad at the date of the passing into law of Constitution (Amendment No. 24) Act, 1936 (18 of '36), shall be at liberty to proceed in the Dáil with a Bill identical in all respects with the Bill which was so pending, without examination for compliance with the Standing Orders relative to Private Business;

(2) that notice of intention to proceed with the Bill shall be given by the promoters by depositing in the Private Bill Office a copy of the Bill together with a certificate signed by the Parliamentary Agent for the promoters annexed thereto stating that the Bill is identical in all respects with the Bill which was so pending in the Seanad;

(3) that on the day on which the Dáil shall next sit subsequent to such notice of intention having been given, the Bill shall be set down for an Order referring the Bill to Select Committee in pursuance of Standing Order 66 (Private Business), the Bill being deemed to have been introduced and to have passed its second stage;

(4) that no fees shall be charged in respect of any stage of the Bill when fees were already paid in respect of the similar stage in the case of the Bill so pending in the Seanad.

The Committee on Standing Orders considered the motion which is before the House, standing in my name, and concurred in it. The Bill referred to in the motion, the Local Government (Galway) Bill, 1934, had been committed to a joint committee prior to the abolition of the Seanad. The joint committee was not in fact appointed, as the promoters were not ready at the time to proceed with the Bill and no further steps in reference to the Committee Stage of the Bill were taken up to the date of abolition of the Seanad.

The promoters are desirous to proceed now with their Bill, but owing to the abolition of the Seanad it is considered necessary that the Bill should be introduced de novo, but it is suggested that the promoters might be spared the cost of advertising the Bill and the other expenses incidental to compliance with the Standing Orders relative to Private Business, and this motion was accordingly framed with that end in view. I beg to move the motion.
