The Diseases of Animals (Bovine Tuberculosis) Act, 1957, provides that the compensation payable for reactors shall be the market value of the animal as defined in the Act.
Could be Minister indicate who fixes the market price and, the market price being fixed, is there any appeal?
There is. An officer of the Minister for Agriculture fixes the price. He is instructed to fix the price on the basis of the animal being sold without any knowledge, as it were, of the beast being a reactor. If the owner is dissatisfied he can appeal to an independent arbitrator and have the price fixed by that independent arbitrator.
