Vol. 172 No. 1

Ceisteanna—Questions. Oral Answers. - Minority Reports of Commissions.

1.

asked the Taoiseach if it is a matter of future Government policy to disallow the furnishing of minority reports by commissions set up by legislative enaction in this country.

Could the Taoiseach indicate why this particular clause is being put into the Constitution?

There is a somewhat similar clause in the Constitution in regard to certain judgments of the Supreme Court.

I did not hear what the Taoiseach said.

What I said is that it is in accord with similar provisions where a judgment has been given by the Supreme Court in certain cases.

Is it not usual for commissions to be able to give minority reports?

This is a special commission with, to a certain extent, a final decision except in so far as it may be rejected subsequently by the Dáil.

Could the Taoiseach not indicate why he is not prepared to allow a minority report in this case? There does not seem to be any particular reason why he should not.
