asked the Minister for Justice whether he has examined the evidence sent to him in relation to the operation of a pools organisation; whether he is satisfied that such evidence establishes that prima facie the organisation concerned is not operating strictly within the provisions of the Gaming and Lotteries Act, 1956; and what action is proposed to be taken in the matter.

I have not received from the Deputy any evidence to support his assertions that the provisions of the Gaming and Lotteries Act are not being observed. If I were to receive such evidence I would pass it on to the police but there is no reason why the Deputy should not himself communicate with the police.

asked the Minister for Justice whether the pools and lotteries operated by a pools organisation (name supplied) are authorised by court licence issued pursuant to the Gaming and Lotteries Act, 1956; and if so, whether that fact is set out in the membership cards and in the literature issued to subscribers.

Court records show that nominees of the organisation concerned have been authorised by licence to run at least four different lotteries for different objects of the organisation. It does not, however, follow that the organisation is availing itself of the authority given by all of these licences and I do not know what lotteries it is in fact running or what particulars are given on documents supplied to the subscribers.

I should like to make it quite clear that there is no reason why I should have information on either of these points. Law enforcement is a matter for the Garda Síochána and if the Deputy has evidence that the organisation is breaking the law, I suggest that he should communicate it to the Garda Síochána.
