asked the Minister for Transport and Power what is the position regarding payment of compensation to landowners through whose lands railways are built; and what is the position regarding the compensation of a landowner (name supplied) through whose land a railway is being built.

Land may be compulsorily acquired by CIE for the purpose of the construction, maintenance and operation of railway works authorised by orders made under section 6 of the Transport Act, 1963. Compensation is payable by the Board to the several persons having estates or interests in such land and any question of disputed compensation falls to be determined by arbitration in accordance with the provisions of the Acquisition of Land (Assessment of Compensation) Act, 1919.

The land referred to in the question is being acquired by CIE for the construction of the Silvermines extension railway under an order made by me under the Transport Act, 1963 on 22nd April, 1966. I am informed by CIE that the Board is at present awaiting a duly completed notice of claim for compensation from the landowner in question so that negotiations in regard to compensation may proceed.
