asked the Minister for Local Government to what extent are local authorities bound to collect garbage; how is trade or household waste defined; and if he will state the regulations regarding the collection of garbage.

The law provides that every sanitary authority may, and when required by ministerial order shall, themselves undertake or contract for the removal of house refuse from premises and that if the authority is required by the owner or occupier of any premises to remove any trade refuse, other than sludge, they shall do so. In the latter instance, the owner or occupier is required to pay the authority for doing so a reasonable sum to be settled, in the case of a dispute, by order of a court of summary jurisdiction.

House refuse has been judicially defined as meaning such refuse as arises from inhabitancy or domestic occupation of a premises and trade refuse as the refuse of any trade, manufacture, or business, or of any building materials.

Is the Minister aware that many local authorities are not carrying out their function in this regard and that it is leading to dangerous pollution of the air——

I am not so aware.

asked the Minister for Local Government the cost of disposing of domestic and street refuse annually to Dublin Corporation; and the estimated cost of disposing of the rubbish by incineration.

The accounts of Dublin Corporation for the year ended 31st March, 1969, show expenditure of £1,018,267 for sanitary services cleansing.

As regards the cost of disposal of refuse by incineration, I would refer the Deputy to reply to Question No. 31 of 18th November last in which it was stated that Dublin Corporation estimated a few years ago that the disposal of refuse by incineration would entail a capital cost in excess of £2 million and that each ton of refuse dealt with would entail a further increase of from 15s to 20s per ton as against the then cost of 3s 7d per ton for disposal by the normal method of controlled tipping.
