Vol. 249 No. 14

Ceisteanna—Questious. Oral Answers. - Private Housing Estates.

43.

asked the Minister for Local Government if he is aware that Dublin County Council are having difficulty in taking charge of private housing estates, some of which have been finished for years; and that the local residents are most anxious to have such estates taken over by the council; and, if so, if he will have the cases examined.

I am aware that there has been a problem in the County Dublin area for many years about private housing estates which have not been properly completed and which, because of this, have not yet been taken in charge by the county council. Some of these estates were developed on the basis of permissions granted under the Planning Act of 1934 and I feel that the Local Government (Planning and Development) Act, 1963, went as far as possible in enabling planning authorities to apply enforcement powers to these older estates. Where it has become clear that these enforcement powers are not going to provide a solution — in cases where, for example, the terms of the original permission were vague or imprecise or where the developers have died or gone out of business — it is a matter for the county council to take such other measures as are open to them to deal with such cases.
