asked the Minister for Lands if it is the intention of the Land Commission to purchase from a person (name supplied) for distribution among local smallholders a holding at present being sold privately at Bohergoy, Maddenstown, County Kildare.

Inquiries were made some time ago regarding this 37-acre property but, because of the personal circumstances of the occupier, it was decided not to proceed further in the matter at the time. It is understood that the lands are at present in process of being sold and the Land Commission are having up-to-date inquiries made.

Is the Minister aware that some months ago I brought to the notice of the Land Commission the fact that this land was likely to come on the market and that it represented the last opportunity of making smallholders in the locality viable? Would the Minister not agree that in view of the fact that three or more smallholders are placed in this position because of the Land Commission attitude some years ago that the Land Commission cannot wash their hands of the responsibility of making these smallholders viable? Further, would the Minister not agree that it would appear from the decision that is likely to be made in this case that the Land Commission have failed to perform their primary function and that a shake-up is badly needed in that establishment?

I am sure the Deputy is aware of the personal situation which was involved in this case. In my view it was quite understandable that the Land Commission would not move on this property at the time. However, as I have pointed out, it is now understood that the lands are in the process of being sold and the Land Commission are having an up-to-date investigation carried out.
