asked the Minister for Local Government if, in view of a decision of the Circuit Court on claims resulting from the cratering of roads in Border areas by the British Army, any decision has been taken regarding the indemnifying of local authorities who are faced with such claims.

I would refer the Deputy to the replies given to Questions No. 10 of 24th February, Nos. 10 and 19 of 1st March, and No. 20 of 5th July, in this matter. The whole question of damage caused to property in this State as a result of the cratering of cross-Border roads by British Forces is being kept under review by all of the Ministers who are concerned in this matter.

Is the Minister aware that decrees have been given against Monaghan County Council and that the judge in making the decree said:

In doing so my sympathies are with the ratepayers of County Monaghan.

The Deputy may not quote. He may paraphrase.

He said:

It is entirely left on the shoulders of the ratepayers of Monaghan and it is an injustice that they should not have to pay the damage for. It was committed by a third party.

Has the Minister given consideration to these comments or is he aware of them? Would he be more specific as to whether he intends to indemnify the county council against any damage?

I am aware of the case mentioned by the Deputy relating to Monaghan County Council. All I can say is that this matter is being kept under review by all the Departments concerned, including my own.

How long will the Minister keep this under review or when can we expect a decision?

I am afraid I cannot give the Deputy a definite indication at the moment.
