asked the Minister for the Environment if he is aware of the concern of the residents of Kilnamanagh Estate, Tallaght, Dublin, and adjoining areas regarding atmospheric pollution which results from the operation of a factory (details supplied) in Tallaght; and, if so, the steps his Department are taking or can take in the matters.

I am aware of the concern of local residents about emissions from this factory. I understand that planning permission was granted on 3 November 1980 by An Bord Pleanála in respect of this factory subject to certain conditions. It is for the Dublin County Council to take appropriate action to ensure compliance with such conditions. I understand that the council have not been satisfied that all the conditions imposed by An Bord Pleanála have been complied with and they are at present actively pursuing this aspect of the matter with the company concerned.

Can the Minister say what steps the council intend to take in this case?

It appears that the company have not complied with the conditions which oblige them to make arrangements for the monitoring of emissions in agreement with the planning authority. As a result, the planning authority issued a latest day notice under section 31 of the 1963 Planning Act. The notice was issued on 20 March last, specifying 30 April as the deadline for compliance with the conditions.

Do the Department intend to take steps from the environmental point of view?

This is a matter for Dublin County Council. The Department are satisfied they are taking these steps.

Can the Minister say if the latest day notice has been complied with and if not if the council have taken the next step in the legal machinery?

The present position is that Dublin County Council are considering the enforcement proceedings against the owner of the factory.

Have the conditions in respect of the final day, 30 April, been complied with?

Does not the 1976 Act lay down what should be done?

It is a matter for the county council, of which Deputy Boland is a member.
