asked the Minister for Social Welfare having regard to her decision in the case of a person (details supplied) in County Louth if she will now state when he will be paid his arrears of disability benefit from January 1985; and if she will make a statement on the matter.

Payment of disability benefit to the person concerned was disallowed in respect of various periods from 5 July 1982 as it was established that he concurrently worked and claimed benefit during these periods. He appealed against the disallowance and the case has been referred to an appeals officer who proposes to hold an oral hearing as soon as possible.

The recent decision made in relation to the work performed by the person during the period of the disallowance only stated that the work he was engaged in was not insurable. Nevertheless this does not alter the decision to disallow disability benefit. This benefit is not payable in respect of any period during which a person is engaged in work which is, or would ordinarily be, remunerated.
