Vol. 365 No. 5

Written Answers - Social Welfare Benefit.

12.

asked the Minister for Social Welfare the present position regarding an application for invalidity benefit from a person (details supplied) in County Donegal.

To qualify for invalidity pension a person must be permanently incapable of work as well as satisfying contribution conditions.

The person concerned was examined on 12 December 1985 by a medical referee who did not consider him to be permanently incapable of work. He was reexamined on 5 March 1986 by a different medical referee who also expressed the opinion that he was not permanently incapable of work. He has appealed against the decision not to award invalidity pension and a form has been sent to him requesting a statement of the facts and contentions upon which he relies in support of his appeal. When the form is returned his case will be submitted to an appeals officer for determination.
