312 Mr. J. Mitchell asked the Minister for the Environment and Local Government if, in respect of the sale of flats and duplex apartments to local authority tenants, progress has been made in resolving the legal difficulties; if he will explain the legal and-or administrative difficulties that cannot be overcome in view of the fact that, in inner city Dublin, flat complexes located alongside private apartment blocks are sold to individuals; and if he will make a statement on the matter. A detailed examination of the issues which arise in relation to the sale of local authority flats, carried out some years ago in consultation with local authorities, concluded that no adequate arrangements could be made which would be satisfactory to tenant purchasers, local authorities or the other tenants in a flat complex who did not wish to purchase. The main difficulties involved were, apart from any legal issues, the level of management charges necessary, public liability insurance issues and the future saleability of purchased flats.

However, in the light of the increased activity in the sale of private sector apartments in recent years and following consultation with my Department, I understand that Dublin City Council are in the process of engaging consultants to advise them on a scheme for the sale of local authority flats to tenants. On receipt of the consultants' report the issue will be considered further.
