asked the Minister for Defence whether he is aware that a boy named John D. Donovan, of Timoleague, Co. Cork, was permanently maimed as a result of a shot fired by a military sentry at Timoleague, Co. Cork, on 8th April, 1923; whether the amount of compensation offered was £5, and whether, in view of the injuries sustained by the boy Donovan, the award will be increased.

I am not aware that John Donovan was permanently maimed. The sum of £5 was not offered as compensation, but as an ex-gratia payment to help to cover incidental expenses. As there is no legal liability on the military authorities to pay any compensation, I regret that it is not practicable to increase the sum mentioned.

May I ask the Minister if he is aware that this boy has lost the use of his arm entirely, and that he is willing to submit himself to any medical examination in order to prove that the statement is true?

I am advised that the liability of the Government cannot be sustained, that is to say, the legal liability of the Government.

Is the Minister aware that the sentry who fired the shot was on duty and was imprisoned as a result of that action?

I am not aware of that fact. I will look into the matter again. I am advised there is no legal liability.
