asked the Minister for Home Affairs whether in the case of Laurence Kelly, of Tournanough, Kileumin, Co. Kerry, who was arrested under the Public Safety (Powers of Arrest and Detention) Temporary Act, 1924, on the early morning of 25th February, detained in custody in Tralee until March 5th, and then removed to Cork Prison, any opportunity has been afforded to the prisoner to rebut any evidence which may exist to connect him with the crimes with which he is charged; whether the prisoner has been given facilities to appeal to an Appeal Council, and, if so, how long may be expected to elapse before the appeal is heard; and whether he is prepared to take recognisances for the release of this prisoner.

The prisoner referred to was detained under the provisions of the Public Safety (Powers of Arrest and Detention) Temporary Act, 1924, on very strong suspicion of having been concerned in an armed raid on the Gárda Síochána Barrack, Scartaglen, Co. Kerry, which resulted in the death of Sergeant Woods. As a result of further investigation, the Minister for Home Affairs was satisfied that the suspicion against Laurence Kelly was not sufficient to justify his continued detention, and an Order for his release was given on the 23rd instant.
